Neurons Asia Sdn Bhd (“Neurons,” “we,” “us,” or “our”) respects your privacy and is committed to protecting the personal data you provide to us. This Privacy Statement is issued in compliance with the Personal Data Protection Act 2010 (“PDPA”) and outlines how we collect, use, disclose, and safeguard your personal information. <\/p>\n\n\n\n

1. Collection of Personal Data<\/strong> <\/p>\n\n\n\n

We may collect the following categories of personal data from you when you interact with us, register for our programs, or use our services: <\/p>\n\n\n\n

– Identity and Contact Information:<\/strong> Name, email address, phone number, postal address, date of birth, and gender. <\/p>\n\n\n\n

– Professional Information:<\/strong> Job title, company name, education history, and work history. <\/p>\n\n\n\n

– Assessment and Profile Data:<\/strong> Information related to neurodiversity profiling assessments conducted by us or our partner, Genius Within (UK) and research with local and international universities, policy research and development with government agencies and ministries.  <\/p>\n\n\n\n

– Sensitive Personal Data:<\/strong> In connection with our assessment and coaching services, we may collect data that is considered sensitive under the PDPA, such as health or medical information related to neurodiversity. Your explicit consent will be obtained for the processing of this data. <\/p>\n\n\n\n

In some cases, the provision of certain data is obligatory to enable us to provide our services. If you do not provide the requested data, we may not be able to deliver the assessment, coaching, or consultancy services you require. <\/p>\n\n\n\n

2. Purpose of Collection and Processing<\/strong> <\/p>\n\n\n\n

We collect and process your personal data for the following purposes: <\/p>\n\n\n\n

– To conduct Neurodiversity Profiling Assessments:<\/strong> To administer and analyze your assessment in collaboration with our partner, Genius Within or any other service providers.  <\/p>\n\n\n\n

– To Deliver Services:<\/strong> To provide training programs, coaching programs, and workspace adjustment consultancy services that you or your organization have engaged us for. <\/p>\n\n\n\n

– For Research:<\/strong> Your assessment data may be anonymized (with all identifying information removed) and used for research, policy research, and development purposes in partnership with local and international universities and government agencies. This anonymized data will not be subject to the PDPA. <\/p>\n\n\n\n

– For Marketing and Communication:<\/strong> To inform you about our current and future offerings, as well as those of our partners, which may be of interest to you. You have the right to opt-out of receiving such communications at any time. <\/p>\n\n\n\n

3. Disclosure of Personal Data<\/strong> <\/p>\n\n\n\n

We may disclose your personal data to the following categories of third parties: <\/p>\n\n\n\n

– Our Partner, Genius Within (UK):<\/strong> To facilitate the administration and delivery of neurodiversity profiling assessments and related services. <\/p>\n\n\n\n

– Service Providers:<\/strong> To companies that provide support services to us, such as IT infrastructure providers, secure data storage, and data analysis. <\/p>\n\n\n\n

– Regulatory Authorities:<\/strong> As required by law or to comply with any legal obligations. <\/p>\n\n\n\n

4. Cross-Border Transfer of Data<\/strong> <\/p>\n\n\n\n

In providing our services, we may transfer your personal data to our partner, Genius Within, which is located in the United Kingdom. The transfer of personal data to a place outside Malaysia is permitted under Section 129 of the PDPA where the place ensures an adequate level of protection, or where the data subject has given explicit consent. Genius Within as an entity in United Kingdom are obligated to comply with The General Data Protection Regulation (GDPR) under the European Union law. By providing your personal data, you consent to such cross-border transfer. <\/p>\n\n\n\n

5. Data Retention and Security<\/strong> <\/p>\n\n\n\n

We will retain your personal data only for as long as it is necessary to fulfill the purposes for which it was collected, or as required by law. After this period, your personal data will be securely destroyed or permanently anonymized. <\/p>\n\n\n\n

We have implemented appropriate technical and organizational security measures to protect your personal data against unauthorized access, collection, use, disclosure, copying, modification, disposal, or similar risks. These measures include secure servers, access controls, and data encryption where appropriate. <\/p>\n\n\n\n

Under the PDPA, you have the right to: <\/p>\n\n\n\n

– Withdraw Consent:<\/strong> To withdraw your consent for the processing of your personal data at any time, subject to any legal restrictions. Withdrawal of consent may affect our ability to provide you with our services. <\/p>\n\n\n\n

– Limit Processing:<\/strong> To request that we restrict the processing of your personal data for marketing purposes (please refer to Section 7 below). <\/p>\n\n\n\n

We will endeavour to respond to any such request within 21 days from the receipt of your request. <\/p>\n\n\n\n
